Resumen: En este trabajo se parte de las tesis de Foucault sobre la integración de ciertos dispositivos de control y de un régimen médico-sexual en el Derecho, que definieron las identidades de los sujetos, para explicar el modo en que estos mecanismos han influido en la regulación jurídica de los cambios de identidad de género. Asimismo, se detalla cómo la medicalización de las identidades por parte del Derecho contradice la evolución del concepto de género. A partir de este análisis, el (...) artículo propone una reflexión sobre algunos cambios legislativos recientes y sobre los puntos de encuentro y desencuentro entre las diversas corrientes al objeto de defender un nuevo discurso justificatorio capaz de reinterpretar los conceptos de autonomía y autodeterminación sexual.Abstract: Taking into account Foucault’s thesis about security dispositives and the medical-sexual regime within law, which have defined the identity of subjects, this paper focus on how these have influenced the legal regulation of gender identity changes. Furthermore, it also focus on how the medicalization of gender identities contrasts with the meaning of concept provided by gender studies. Thus, an examination of recent regulatory changes and the crossing points among the former theories is proposed with a view to promote new meanings and justify discourses in order to reinterpret the concepts of autonomy and sexual self-determination. In the context of reproductive health, policies focused on decriminalising abortion that resulted in religious beliefs, attitudes and behaviours being affected. The main purpose of this article was to identify the religious beliefs of abortion in the emergency situations such as COVID-19. Although there is no general consensus regarding abortion, there is almost ‘general opposition to causing harm to life’ in most religions. In the current study, 28 indicators and four factors (seven for each factor) related to pregnancy termination were (...) explored through an exploratory factor structure. The study was therefore non-experimental, cross-sectional and exploratory, with 100 students selected in a non-probabilistic way. Contribution: The main contribution of this research is to find the variable effects on abortion in emergency conditions regarding religious beliefs. Given the results, behavioural intentions determine a structural model, but religious beliefs explain the solution. Furthermore, data generalisation is not possible due to the context, sample selection and type of analysis. In the local population, a confirmatory factor analysis should be performed with a probabilistic sample selection. (shrink)

Background: Caregivers and administrators in long-term facilities have fragile moral work in caring for residents with dementia. Residents are susceptible to barriers and vulnerabilities associated with the most intimate aspects of their lives, including how they express themselves sexually. The conditions for sexual agency are directly affected by caregivers’ perceptions and attitudes, as well as facility policies. Objective: This article aims to clarify how to approach capacity determinations as it relates to sexual activity, propose how to theorize about patient autonomy (...) in this context, and suggest some considerations for finding an ethically responsible and practically feasible way to respect the sexual rights of this population. Research Design: The focus is on residents with early to moderate dementia in states of daily dependency on professional caregivers. The article critically examines existing empirical research on sexuality among persons with dementia, caregivers’ attitudes, and institutional roadblocks to enabling residents’ sexuality. A relational lens and insights from disability studies are used in the philosophical analysis. Participants and Research Context: No research participants were part of this analysis. Ethical Considerations: This article offers a conceptual analysis and normative framework only. Findings: The analysis highlights the delicate balance that capacity assessments for sexual activity have to strike; while caregivers should protect those who cannot give adequate consent, the denial of sexuality among residents can cause deep, long-ranging harms. Sexual agency features into an ongoing sense of self for many individuals with dementia, and the imposition of inappropriate standards and expectations for sexual autonomy can lead to unwarranted obstacles to sexual activity. Discussion: Recommendations include developing clear and inclusive institutional policies and practices of care, providing education for caregivers on how to discuss and document residents’ sexual preferences over time, and taking advantage of ethics consultation services. Conclusion: This analysis establishes the need for more research and discussion on this sensitive topic. Future research should investigate the specific responsibilities of caregivers in furthering the sexual interests of residents, how exactly to modify existing capacity instruments, and how best to support historically marginalized patients in their sexual identities. In the fall semester of 1772/73 at the Albertus University of Königsberg, Immanuel Kant, metaphysician and professor of logic and metaphysics, began lectures on anthropology, which he continued until 1776, shortly before his retirement from public life. His lecture notes and papers were first published in 1798, eight years after the publication of the _Critique of Judgment, _the third of his famous _Critiques. _The present edition of the _Anthropology _is a translation of the text found in volume 7 of _Kants (...) gesammelte Schriften, _edited by Oswald Külpe. Kant describes the _Anthropology _as a systematic doctrine of the knowledge of humankind. Kant’s lectures stressed the "pragmatic" approach to the subject because he intended to establish pragmatic anthropology as a regular academic discipline. He differentiates the physiological knowledge of the human race—the investigation of "what Nature makes of man"—from the pragmatic—"what man as a free being makes of himself, what he can make of himself, and what he ought to make of himself." Kant believed that anthropology teaches the knowledge of humankind and makes us familiar with what is pragmatic, not speculative, in relation to humanity. He shows us as world citizens within the context of the cosmos. Summarizing the cloth edition of the _Anthropology_,_ Library Journal_ concludes: "Kant’s allusions to such issues as sensation, imagination, judgment, taste, emotion, passion, moral character, and the character of the human species in regard to the ideal of a cosmopolitan society make this work an important resource for English readers who seek to grasp the connections among Kant’s metaphysics of nature, metaphysics of morals, and political theory. The notes of the editor and translator, which incorporate material from Ernst Cassirer’s edition and from Kant’s _marginalia _in the original manuscript, shed considerable light on the text.". Can a subject who expresses a belief with ‘today’ on a given day, and subsequently loses track of time, retain and re-express that belief on a future, potentially distant day? Since Kaplan’s tentative remarks on Rip Van Winkle, it has become popular to answer this question in the positive. However, a remarkably simple variation of the Rip Van Winkle story can show that this kind of view leads to a puzzling dilemma: either subjects cannot re-express a belief with utterances of (...) ‘today’ on the same day, or else they may rationally exhibit conflicting stances toward the same ‘today’-belief. This result may be seen as supporting the claim that retention of ‘today’-belief over time requires the tracking of days. Yet it may also spur further research into the capacities involved in belief retention and re-expression to solve the puzzle. (shrink)

Se indica cómo la tradición paulina opta por la "locura de la predicación" como medio y salida del cristianismo para acceder a la salvación por vía de la "locura de la cruz".

Dallas Willard makes the claim that spiritual formation “refers to the Spirit-driven process of forming the inner world of the human self in such a way that it becomes like the inner being of Christ himself.”1 Can this claim be substantiated and stand up to close scrutiny, or is Dallas Willard selecting an idea of his own fancy and making this the cornerstone of his understanding of spiritual formation? How can this claim be tested and anchored? In this article we (...) will seek to answer these questions by looking at the Apostle Paul in his function as spiritual director. Although it is patently anachronistic to speak of Paul as spiritual director, can we legitimately understand him in this role? We will propose a generative understanding of spiritual direction and then proceed to examine the Apostle Paul and his aims based on that generative understanding. We will also argue that at the core of Paul's functioning as a spiritual director lies a strong appeal to examine and imitate his life and character and to follow his ways. This appeal by Paul for others to imitate him is anchored in Paul's own imitation of Christ himself. Paul's call to imitation thus provides a window into discovering how Paul understood his role as spiritual director and also provides us the means to discern his goals in spiritual direction. In his review of The Neo-Stalinist State, Luke reproaches me for neglecting both “the new importance of the USSR's and Eastern Europe's niche in the world economic system” and the use of the East-West economic exchange by the Soviet regime to “sustain its ‘neo-Stalinist’ state.” These criticisms are well taken. Yet, I deliberately concentrated on the inner workings of the Soviet state in its mature form without going into the problems of the Soviet position in the global system.
